1. About MindPulse

MindPulse is a wellbeing application designed to provide supportive, non-diagnostic emotional risk insights, pattern recognition, and personalised wellbeing prompts.

MindPulse is intended to support reflection, awareness, and wellbeing. It is not a substitute for professional medical, psychological, legal, or financial advice.

2. Eligibility

You must be at least 13 years old to use MindPulse. If you are under the age of majority in your jurisdiction, you must use the service only with appropriate supervision or permission where required by law.

3. Non-medical disclaimer

MindPulse:

• is not a medical device,
• does not provide diagnosis,
• does not provide treatment,
• does not replace professional care.

If you are in crisis, feel unsafe, or require urgent support, contact local emergency services or a qualified healthcare professional immediately.

4. Accounts and access

To use some features, you may need to create an account or sign in through a supported authentication provider.

You are responsible for:

• maintaining the confidentiality of your account,
• ensuring login details are accurate,
• all activity under your account where you fail to safeguard it.

We may suspend or terminate access where necessary to protect the platform, comply with law, or address misuse.

5. Health integrations and permissions

MindPulse may offer optional integrations with services such as Apple Health or Google Fit.

You control whether to connect these integrations. If you choose to connect them:

• you grant permission for the authorised data categories,
• you may revoke permissions later,
• some features may become limited if permissions are removed.

6. Acceptable use

You agree not to:

• misuse the service,
• attempt to gain unauthorised access,
• interfere with the app’s operation,
• reverse engineer the service except where permitted by law,
• use the app in a way that violates law or the rights of others,
• upload malicious code or engage in abusive activity.

7. Intellectual property

All content, branding, design, software, and functionality of MindPulse, except content lawfully supplied by users or third parties, belongs to AINAP Ltd or its licensors and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use MindPulse in accordance with these Terms.

8. User content and inputs

Where you provide responses, preferences, reflections, or other inputs:

• you retain ownership of your content,
• you grant us the limited rights necessary to operate and improve the service,
• you confirm you have the right to provide such content.

You must not submit unlawful, infringing, abusive, or harmful material.

9. AI-generated insights

MindPulse may generate predictive scores, trends, prompts, or other outputs using machine learning or related models.

These outputs:

• are indicative,
• may not always be accurate,
• should not be relied on as diagnosis or professional advice,
• are intended to support wellbeing and reflection only.

You remain responsible for how you use any information or insights provided by the service.

10. Availability and changes

We may modify, suspend, or discontinue parts of MindPulse at any time, with or without notice, where reasonably necessary.

We do not guarantee uninterrupted availability, error-free operation, or that all features will always remain available.

11. Privacy

Your use of MindPulse is also governed by our Privacy Policy. Please review it carefully.

12. Fees and future paid features

MindPulse may currently be offered free of charge or with limited-access models. We may introduce paid plans, subscriptions, enterprise services, or additional paid features in the future.

If paid services are introduced, additional billing terms may apply.

13. Termination

You may stop using MindPulse at any time.

We may suspend or terminate access if:

• you breach these Terms,
• use of the service creates risk,
• required by law,
• necessary to protect users, AINAP, or third parties.

Sections intended to survive termination will continue to apply.

14. Disclaimer of warranties

To the fullest extent permitted by law, MindPulse is provided “as is” and “as available”.

We do not guarantee that:

• the service will always be available,
• outputs will always be accurate,
• the app will meet every individual need,
• use of the service will prevent burnout or any other condition.

15. Limitation of liability

To the fullest extent permitted by law, AINAP Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, goodwill, data, or opportunity arising from use of MindPulse.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify and hold harmless AINAP Ltd from claims, damages, liabilities, and expenses arising from your misuse of the service, violation of these Terms, or infringement of rights of others.

17. Governing law

These Terms are governed by the laws of England and Wales, unless mandatory law in your jurisdiction provides otherwise.

Any disputes will be subject to the courts of England and Wales, unless applicable law requires otherwise.

18. Changes to these terms

We may update these Terms from time to time. Continued use of MindPulse after changes take effect means you accept the updated Terms, unless otherwise required by law.
